Filing an Appeal to the Administrative Court in Warsaw: How to Fight a Negative Visa Decision

3.3
(3)

Receiving a second negative decision from the Polish Consulate regarding your work or student national visa can feel like a major setback, especially when the rejection is based on the uncertain “10th point.” This common reason for denial means the Consulate claims to have information suggesting that your true intentions for visiting Poland differ from those stated in your application. Unfortunately, the Consulate often does not provide a detailed explanation, leaving you confused and uncertain about how to respond.

But you don’t have to accept the decision without a fight. Filing an appeal to the Administrative Court in Warsaw allows you to challenge the Consulate’s decision and require them to explain the reasons for rejection in detail. This process gives you the opportunity to defend your case and potentially secure the visa you need to pursue your dreams in Poland.

Understanding the “10th Point” Rejection

Many visa applicants face rejection under the “10th point,” which allows the Consulate to deny visas based on undisclosed information that they believe contradicts your stated purpose for entering Poland. This can be incredibly frustrating, as the consulate does not explain what this information is or how it led to their decision. As a result, many applicants feel powerless, unable to address the concerns that led to their rejection.

By filing an appeal, however, you can compel the Consulate to provide detailed reasons for their decision. Once these reasons are disclosed, you will have the opportunity to challenge the consulate’s claims in court, present new evidence, and defend your true intentions for coming to Poland.

How to File an Appeal

If you’ve received a second negative decision from the Consulate, you have 30 days to file an appeal to the Administrative Court in Warsaw. During the appeal process, the Court will review the Consulate’s decision and determine whether it was made in compliance with Polish law.

At Legal Immigration Poland, we are experts in handling visa appeals. Our experienced team will guide you through every step of the process, ensuring that your appeal is filed correctly and that your case is presented in the best possible light.

Why File an Appeal?

  1. Detailed Explanation of Rejection: When you file an appeal, the Consulate is legally required to provide a clear and detailed explanation of why your visa was rejected, including any specific information they relied on. This gives you a fair chance to address any misunderstandings or incorrect information.
  2. A Second Opportunity to Defend Your Case: The Administrative Court in warsaw will review the Consulate’s reasons for rejection and evaluate whether the decision was lawful. This gives you a valuable opportunity to present your case again, supported by legal arguments and new evidence if necessary.
  3. Stronger Legal Position: Once the Consulate reveals the full grounds for their decision, you can build a stronger case by directly addressing their concerns. With the help of a skilled immigration attorney, you’ll have a better chance of overturning the negative decision and securing your visa.
