Polish visa cases are among the most demanding and unpredictable administrative proceedings. In practice, this means that even a well-prepared application may be rejected – often for reasons that have not been properly explained or assessed.
In one of our most recent cases filed by Legal Immigration Poland, the Voivodeship Administrative Court in Warsaw overturned the decision of the Consul of the Republic of Poland in Cairo, ruling in favor of our Client. Additionally, the court awarded reimbursement of legal costs in the amount of PLN 780.

What led to the decision being overturned?
The court pointed out significant shortcomings on the part of the authority, in particular:
- failure to properly clarify the factual circumstances of the case,
- omission of important documents,
- failure to take into account information regarding the applicant’s employment and income,
- procedural errors made by the Consul.
This shows that visa decisions are not always final – and that judicial review by an administrative court can produce real results.
Polish visa cases – why are they so difficult?
Polish visa proceedings are characterized by:
- a high degree of discretion on the part of authorities,
- limited access to appeal measures,
- short deadlines,
- specific criteria for assessing the credibility of the applicant.
Additionally, many people are unaware that procedural errors on the part of the Consul may constitute grounds for successfully challenging a decision.
Can every visa decision be appealed?
No. This is very important.
Not all visa decisions are subject to review by an administrative court. The possibility of filing a complaint with the Voivodeship Administrative Court depends, among other things, on:
- the type of decision,
- the legal basis for its issuance,
- the procedure under which it was issued.
Therefore, each case requires individual analysis.
